These Terms & Conditions ("Terms") govern your access to and use of www.thoughtgallery.org (the "Site") and any content, newsletters, event listings, email communications, and services offered through the Site (collectively, the "Services").
The Site and Services are published by Davler Media Group, LLC, a Delaware limited liability company ("Davler," "Thought Gallery," "we," "us," or "our"). By accessing or using the Site or Services, you agree to these Terms. If you do not agree, do not access or use the Site or Services.
1. About Thought Gallery and Our Services
Thought Gallery is an editorial platform dedicated to the intellectual life of New York City, curated for the "Thoughtlectual" community. Our Services may include:
Editorial articles and curated listings for talks, panels, readings, tours, and screenings.
Distribution of The Curriculum weekly email newsletter.
Syndication of selected intellectual and cultural content to distribution partners.
Publication of clearly labeled sponsored content or paid partner communications.
No User Accounts: The Site does not offer user accounts or profiles at this time.
2. Sponsored Content and Advertising
Thought Gallery may accept advertising, sponsorships, and paid placements.
Disclosure: Sponsored or paid placements are intended to be clearly labeled.
Editorial Independence: Thought Gallery editors retain sole discretion and absolute control over all editorial decisions, including what content is published, edited, or declined.
Advertiser Responsibility: Advertisers are solely responsible for the accuracy and legality of all submitted materials.
3. Event Information and Disclaimers
Thought Gallery provides a resource for discovering intellectual activities. Event information (dates, pricing, speaker line-ups, etc.) may change at any time. By using the Site, you acknowledge and agree that:
You will verify all event details directly with the host institution or venue before attending.
The event organizer is solely responsible for event operations, ticketing, and fulfillment.
Thought Gallery is not responsible for inaccuracies, cancellations, or outcomes related to any event.
4. Third-Party Links and Services
The Site contains links to third-party websites (e.g., museums, universities, or ticketing platforms). Thought Gallery does not control these third parties and is not responsible for their content, policies, or transactions.
5. Submissions From Institutions and Event Organizers
Institutions, venues, and organizers may submit events or media for consideration ("Submissions"). By submitting, you represent and warrant that:
You have the authority to grant the rights described below and the Submission is accurate and lawful.
License Grant: You grant Thought Gallery a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, and edit the Submission across all Davler Media Group platforms and syndication partners.
Indemnity: You agree to indemnify Thought Gallery from any third-party claims (e.g., copyright infringement) arising from your Submission.
6. Intellectual Property and Permitted Use
All content on the Site—including text, images, graphics, and the "Thoughtlectual" branding—is owned by Davler Media Group or used under license.
Permitted Use: Personal, non-commercial use only.
Prohibited Use: You may not copy, scrape, or republish visual media or text without prior written permission.
AI Training Prohibition: You may not use Site content to train, fine-tune, or develop artificial intelligence or machine learning models.
7. Acceptable Use
You agree not to interfere with Site security or transmit malicious code. Thought Gallery may terminate access for violations of these Terms.
8. Payments for Advertising
Purchases are subject to the applicable pricing and "Order Terms" provided at the time of purchase.
Payment Processing: Handled via Authorize.net or designated processors.
Refunds: Advertising and sponsored placements are generally non-cancellable and non-refundable.
9. Privacy
Your use of the Site is subject to our Privacy Policy, which describes our use of cookies and analytics tools (e.g., Google Analytics 4, HubSpot).
10. Disclaimer of Warranties & Limitation of Liability
"As Is": THE SITE IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND.
Liability Cap: TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PRECEDING THREE (3) MONTHS, WHICHEVER IS GREATER.
11. Governing Law and Venue
These Terms are governed by the laws of the State of New York. Any legal action shall be brought exclusively in the state or federal courts located in New York County, New York.

Thought Gallery is dedicated to making the intellectual and cultural life of New York City accessible to all. We are working to ensure that our database of lectures and events is usable by individuals of all abilities.
Accessibility Features we are currently focusing on:
Keyboard Accessibility: Ensuring that users can navigate our event calendars and search bars using only a keyboard.
Screen Reader Optimization: Labeling all forms (such as newsletter sign-ups) so they are correctly identified by assistive technologies.
Plain Language: Organizing content to be clear and easy to understand for all users.
Limitations and Disclaimers: Thought Gallery often links to external venue websites. While we strive to ensure our own platform is accessible, we cannot control the accessibility of the external sites we link to.
Manual Help: If our digital calendar is not working with your assistive technology, our staff is available to help you find event information.
